My fiancé is from Indonesia and we've been planning to get married for a while now. I was planning to visit her in a few weeks. Unfortunately, her health has taken a trun for the worse and really would like to bring her here to the US to get better medical help. She currently, has a B2 travel Visa. I'm not sure if we can marry overseas and bring here here, but I need to know if this is possible or she has to continue to wait. It is quite difficult for her to travel alone since she was diagnosed recently with Renal Failure and has become blind.

 

Must I file for the K1 Visa and wait for acceptance before brining her here? If I submit a K-1 will she immediately loose her B-2 Visa?

 

I would appreciate it if could give me some guidance on what path to take and if I can bring her with me legally.

you should be able to get married over seas

you can also get married online through Utah Online Weddings

 

if you get married before filing a K-1 visa, you are no longer eligible for that one and will have to file for the CR1/IR1 visa (spousal visa) which is usually a better choice overall

 

you will have to wait regardless for either the K1 visa or the CR1/IR1 visa

 

 

if the K1 visa is approved (not just the I-129f petition, thats different) the B2 visa is no longer valid

 

you would be submitting the I-129f petition. the application for the K1 visa comes later down the line after USCIS approves the I-129f petition. which can take anywhere from 6 - 18 months.
