Hi there folks I'm a long time lurker, first time poster. Here's our background:

- my wife is the USC

- I am a UK Citizen

- I entered on a K-1 in April '07

- married in May '07

- filed for AOS, EAD and AP simultaneously in June

- NOA for all 3 dated June 17

We made a mixup when we filed the I-864 and failed to include any detail for the Tax Year 2006. I've received a 'Request for Initial Evidence' relating to my I-485 and I'm concerned about one line in the letter:

'You are ineligable for interim employment authorization pursuant to Title 8, Code of Federal Regulations, Section 103.2(B)(10)(ii)until ninety (90) days after the missing initial evidence is received'

Does this mean they will put a hold on my EAD (I-765) or AP (I-131) until we submit the correct information. The only reason I ask is because it might take us some time to put together my wifes tax info for last year.

Any advice appreciated.

Yes, the processing of the EAD is put on hold until you respond to the RFE. However if you do so quickly, many people have still received their EAD before the 90 day processing time, so the bit about "until 90 days after missing initial evidence is received" is mostly not true.

I agree, do not worry and get the info back to USCIS as soon as possible
