I haven't contacted an attorney on the matter, but I'd read that someone coming over on a tourist visa with the intent to marry is a big no-no. Granted, they'd have to prove that the intent existed, but I think they'd be able to prove it easily enough given the circumstances.

I think what you are missing is that you can still marry but she'll have to return home and wait for spouse visa process to complete instead of a fiancee visa. There is not hindrance to the marriage, just the adjustment of status after entering on a visa that doesn't allow adjustment of status.

The tourist visa allows marriage but doesn't provide for adjusting status if marriage was intended upon entry.

So, whether to marry on this trip and go the spouse visa route or not marry and go the fiance route is up to you.
