Calling everyone going thru Islamabad Embassy, version 2.0

Hafiz I would think she would have to come back to the USA, set up domicile, and get a job. Then she could file the I-130 and let it process thru the system and once approved her husband would come back to the US on IR-1. Having no domicile and job in the USA will be an issue.
She is a US citizen, her passport expires in 2008. She moved to pakistan a while back like a few years ago. And so she got married in pakistan and she lives in pakistan. Now she wants to bring her spouse to US. she has been in pakistan for more than 5 years, What is the process she must follow. Can she file for directly through embass. She does not have any relatives in US. Everyone moved to pakistan 5-7 years ago.

I agree with Mary. I was reading on DOS Website about this.She will have to come here and set up a domicile. You can read about this in detail if you go to Immigrant Visa and then Affidartive of Support(I-864) section at DOS website. Please see the attched file and if possible, email it to your friend. It is from DOS website and explains in detail about domicile and who, how, and when is it needed. regards, kim

Check these links and you can also do google on direct consular filing. I think she can do DCF, but only if she is working for a US company or US government in Pakistan. Otherwise, as far as I can see, for I-864, she will need that domiclie thing as described in the file that I attached. But if she has no other option, then, I would suggest, just go to the embassy and file the I-130 there and let's see what they say.

Hafiz one of the members on this forum a while back husband was put on AR/AP (substanial time) and went and lived with her spouse in Pakistan. The embassy refused to issue the visa or lift the AR/AP until she came back to the USA, found a home and sent lease or rental agreement, she made pictures of herself in USA with the local newspaper and the dates marked, and had a job for the I-864. I am not sure if they have the visa yet.

You can DCF if you have only lived a few months in Paksitan and still have residence and job in USA. Like Kim posted read the links and you will see that they are strict with these two requirements. You must have domicle and cannot be a burden on the US government.

I am perfect example for your friend.

Go for DCF and let your friend stay in Pakistan with her husband till the packet 3 or 3.5 arrives. Once it's reached, your friend must fly to USA in order to establish domicile. So now when the date of interview is declared, she may come back but then she could not stay more than 6 months in Pakistan.

Holding a job in USA is good sign but not compulsory. You will need I-864 and 864A.

hey everybody! Hope everybody is doing well! We are hanging in here. Man life is busy in the USA. Working my butt off, planning to buy a house now! planning to go back to School as my company will pay for it. Even though masters seems like such a looong program...

Anyways I think its times to AOS now.. Shall I go IR1 in Pakistan or AOS in the US, I think I will go for IR1 in Pakistan as I dont like the Immigration people in the US. The DOS people in Pakistan were a lot nicer!

Another good news!! We got our visa!!! My fiance got his visa on the 12th ... the AMEX people called him on the 11th and asked him to come pick his stuff from their office =) Inshallah he is gonna be here soon!!

Thanks to all VJers for their help and support and alot of prayers for all the others in the waiting mode. The good news is that ISL embassy has seem to pick up the slack :D Inshallah all of you will hear good news soon too!

Anddddd ... I will need some more support in the coming months regarding AOS etc ... soooo thanks in advance for that =) :dance:

Well, our case is cuising through NVC smoothly (mashallah) and only DS230 is left to be generated.

I am leaving for Pak in a week and planning to send DS230 from Pak once I hear from NVC that it has been generated.

Does anyone see any issue if I send DS230 from Pak via FedEx? What should I write as "sender's" address? Address in Pak or US?

How are you planning to include the Bar code document? Checklist? Have you asked someone what is exactly in the DS-230? NVC may have changed list of the required documents. I have heard that some folks from this site have sent the 3032 before even it was generated. And it was accepted by the NVC.

Now as far as sender's address is concern. Here is what i suggest:

You should always write the choice of agents address for "Sender's address". If you are the petitioner and also choice of agent then you should write your address as "sender's address".

Now the problem is that you are in Pakistan and you are sending the 230 before even it gets to your house in USA.

I would say, you complete the DS-230 form before you leave to Pakistan, hand it to your friend/relative whoever you trust the most. Whenever NVC generates the DS 230, have your friend/relative mail the forms to the NVC.

You will have assurance that mail will get their safe, on time and it'll have your origonal address with the US stamps.

Sounds like you have been away from VJ for a long time and you don't have a clue how to generate bar code page. It can be done, and as a matter of fact I have prepared the bar code page already, not going to tell you how cuz I know you are from CA..... :))))
