Hi everyone,

Many of you know me and my case woes! I wanted to know if anyone here is awaiting AOS AND has a pending I-130. We've been waiting for a while and I was told today to sit and wait my turn (though my district office is processing cases received about 9 months after mine!).

I'm a bit concerned as we finally got our EAD but I want to push for movement in the I-485 b/c who knows what kind of problems USCIS will give us with the renewal.

I-485 , I-765, I-130: NOA1 : 1/23/2006

Biometrics 2/23/2006

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

EAD is an interim benefit, if you have received it once, you should receive the renewals as a matter of course, provided you apply with enough time.

If your I-130 is outstanding at the time for your AOS interview then both will be adjudicated together.... it is whats happens for people who file from any other visa but a K1 or K3..... it will have no effect on any renewals for EAD or AP...

Indeed, in fact I have never received confirmation that my I-130 was approved, online it still says pending, despite the fact I have had my Green Card for a while now.

Thanks everyone. I guess all we can do is just wait for our interview--whenever that will be!

I know we have to reapply for the EAD ahead of time, I just hope they don't harass us as much as they did for us to get the initial EAD!
