Hello.  Im looking for some clarification on filing the i864.  I am the petitioner, LPR, bringing child under 21.  I know I file the i864.  But since I dont have meet requirements I need a joint sponsor.  My son in law would be the joint sponsor.  Do I include him on the same i864 or he files a separate one?, and he files an i864a.  His wife, my daughter, would she also need to complete an i864 and file a separate i864a? (since they file a joint return). or just him? 

 

Or since we are the same household, but file separate tax returns, is it 1 i864, and 1 i864a for him only or both him and her?

Hi,

 

While all three of you are living together, for the purpose of the Affidavit of Support, there are two different household.  You as one.  Your son-in-law and his wife is another household.

 

I-864 for you as the petitioner/sponsor.  Your son-in-law and his wife are not counted in your household.  

 

Separate I-864 for your son-in-law, the Joint Sponsor.  You are not included in his household count.   The Joint Sponsor's wife files an I-864a as a Household Member of the JS.

 

The intending immigrant in counted in both your I-864 and your son-in-law's I-864.
