Received Notice of Intent to Deny for AP. Please help!!

My husband's I-485 is currently pending at TSC. He e-filed for AP abot a month ago, and just received a weird looking letter (Notice of Intent to Deny). Could this be an RFE?? He sent all the required supporting documents the very next day after e-filing. Someone please help! We have no idea what they're asking for

This office is unable to complete the processing of your application without further information. Please read and comply with the following request. Submit the requested evidence to the above address. The documentation should be attached together with the gold sheet on top. Failure to reply within 30 days may result in the denial of your petition.

Please submit proof that you have submitted an underlying petition such as an I-140 (Immigration Petition for Alien Worker), I-360 (Petition for Amerasian, Widower, Special Immigration) or I-526 (Immigration Petition by Alien Entrepreneur). If you are the derivative, please provide proof of the underlying petition (I-140, I-360, or I-526) for the Principle applicant.

I have no idea what they're asking for..... and let me just mention that the "above" address they speak of is a P.O. box in Mesquite, TX, while the gold sheet, has a P.O. Box in Dallas, TX.

Yep yep! The very next day after e-filing using Priority w/ delivery confirmation.

And may I add that bu "weird looking", I'm talking about a plain letter, on a plain white piece of paper, not even an official USCIS paper.

Yep yep! The very next day after e-filing using Priority w/ delivery confirmation.

What did you send them? Copies of the NOA1s? If so they must have just messed up.

I'd add that given you have to send them a bunch of paperwork anyway, I don't see the benefit of e-filing. I think actually it probably makes it more likely for stuff like this to happen.

We definetly sent all the required documentation. Passport photos, copy of NOA1, transfer notice,

statement of why he qualifies for advanced parole. They have received everything and have been actively working on it. I guess telling us that e-filing was a bad choice is not really gonna help at this point

Oh no Seldi. I'm sorry I don't have anything to suggest or offer. I am worried about your AOS though (unless I have missed a post from you where it explains the purpose for TSC transfer for family based adjustment).

I'm beating myself up right now over this. It's really all my fault. I decided to e-file because we could pay with a credit card and at that time, I was annoyed by my bank because they kept screwing up my last name (and I was unable to write checks). Stupid, stupid!!.

And no, we never found out why his AOS was transferred to TSC (one of the reasons why we scheduled the missinfopass a couple of months ago).

But I like I said, the letter still looks so weird to both of us. We just realized that the envelope, letter, and cover letter all have 3 different addresses. Also, why would they ask him send something to DALLAS when his application is in Mesquite....it just doesn't add up.

Man, it looks like a 5 year old folded this letter...also, the USCIS logo on the letterhead and envelope don't quite match any other USCIS logos. And again I ask myself....why didn't they use the official USCIS paper? Yeah, I'm not sleeping tonight....

Don't beat yourself up over this. We are allowed to e-file - it is not your fault that there seems to be an oversight. On the brighter side - maybe this is exactly the evidence of a possible error you need at an infopass appt.

I am hoping you have a positive experience at this infopass.

Either they were not able to match up the supporting documentation with the application, or the supporting documentation that you sent was not as complete as you think it was.

Re-check what supporting documentation is required and send everything again.

One question I have is if you checked the right eligibility category?

Sounds like they are asking for evidence for a different category, you may wish to call and see if you can confirm this.

I'm looking at a copy I made of the I-131 and supporting documents.

1. Application type: Picked the 4th option ( I am applying for an advanced Parole document to allow me to return to the US after temp. foreign travel.)

2. Put K 1 Under "class admission"

3. Submitted the following support docs:

a. Copy of I-485 NOA1 & Transfer To TSC Notice

b. Explanation of eligiblity & reason for traveling

c. 2 identical passport photos

d. Copy of k1 visa and I-94

Maybe they want a copy of the NOA2 for the K1 visa?? They keep talking about "petition".

We have an infopass appointment for next Monday. I just wish I didn't have to miss work. OH well
