I was meaning in terms of sentencing.

I understand.

Sentencing is something that we the people should decide. The judge went to school to interpret and apply the law. They are not there to speak out for the people let alone represent their views.

On the other hand while some judges have common sense others clearly do not as in the case of that idiot judge suing a cleaner for $53 million for a pair of pants.

If the people decided sentencing we'd be back to that "cut his nuts off" lynch-mob bollox on the other thread.

The law should determine an appropriate sentence - the judge's discretion is important (and its not like the judge always urges on the side of ridiculous leniency) and their sentencing decisions should be subject to a process of oversight. Which is more or less what already happens.

JUDICIAL PERFORMANCE REVIEW OVERSIGHT COMMITTEE

This committee works to develop, supervise and administer a program that would review judicial officers for the purpose of improving their performance. The committee developed and completed a pilot program for four trial judges which is being used to develop and implement a permanent statewide plan.
