HELLO,AND WELCOME ..... i thought coldstream was south of the border not coming under scotland maybe i should retake geography again... but hey welcome anyway.. i,am from near glasgow

RGNSCOT whereabouts near glasgow would ye be?? I used ta bed half way between Glasgow n Edinburgh man, just off the M8 :lol: would be a small world if u woz kinda from the same area LOL

Hi,

I just got a call from a lady at the Edinburgh consulate yesterday saying that our oldest son (9) can get his report of birth abroad and his US passport on Tues,3rd July but our youngest son (22 months) doesn't qualify as his dad and I were married when he was born. Doesn't that seem crazy?

Not to worry though, he'll just have to trot down to London with his dad and go the visa route- SOOO much more expensive than the report of birth abroad but what can ya do? We'll just get Davids passport out the way next week and then file hubby and babys I-130s. Not looking forward to that.

Seeing so many others on here succeed is such a boost. Well done it must be so hard!

Has anyone else had children that have been through either process? Is it much the same for spouses? Good grief, I better start getting organized now!

Wait so you are the USC and had your children in the UK and you cannot register your younger son because you were married at the time of his birth? Surely this can't be right??

No, that can't be right at all. My friend has been married to her USC husband for 9 years, has 2 kids by him and both of those kids have dual nationalities...(UKC/USC)

That doesn't seem right to me either. No wonder people don't want to get married these days they seem to be penalised for it everywhere. I would try to recheck to make sure that this lady at the Edinburgh consulate is not just misinformed, it doesn't seem right.

My 5 year old step son did not have to go down with my hubby to London for the interview process because he was under 14 years so your 22 month old may not have to go along on that loooong trip (but it may be different for DCF)

I admit, I wanted to avoid all this red tape for our little guy, and when I was 6 months along with our (now 2 year old) youngest son, I flew home to give birth, so I'm not much help unfortunately :( I do wish you a speedy resolution.

(OT - We had a good friend in Coatbridge! He and his wife and kiddo have just moved north now though to be closer to his family and to give birth to their second! hehe)

I read up on the USCIS site

Where it explains that my physical presence in the US after the age of 14 is inadequate. My dad was in the US navy and I was 11 when we were stationed out here. He retired after 3 years when I was 14 and we stayed in this country. So if me and Malcolm hadn't gotten married 3 years ago then Ethan (the baby) would qualify as well. Malcolm's the dad to both by the way.

You'd think that a child IN wedlock would seem more legit wouldn't you. The punishment for trying to become respectable LOL!

Anyway thanks for letting me know I'm not the only one who finds it ridiculous.

Leney- I'll definately look into whether Ethan has to go to London as well, sure would be easier if he didn't.
