Timeline

Before I found this site I called the 800 asking my question, but now I want to see if maybe I got wrong info from the 800 number. Since a few of you have stated they are useless. lol

I have not worked since March 2004. So I KNOW I don't meet the income requirements. I've been on disability since around November 2005. My question is, what do I need to send in with form I-864 since I have not filed a tax return for the past 3 years. I was told by the 800 rep that I would still need to file the I-864 since he's my husband. And that I should just show proof that I get disability and also send a statement as to why I have no filed tax returns for the past 3 years. Would that be correct? I've already filled out the form and written out a statement. Just waiting on the proof of income from SSI...We've already got my dad as a joint sponser so that's out of the way. I just want to make sure I'm doing the right thing so far.

I would follow those instructions and also get a co-sponsor. You have to fill out the I-864 no matter what because you are the petitioner, but if you can get a co-sponsor then it will help your case and also provide you with the peace of mind knowing that your situation will not be questioned if someone else is willing to take some of the responsibility to prevent your spouse from becoming a public charge. I hope this helps!

I would follow those instructions and also get a co-sponsor. Great news then! He will also have to do the I-864 and send in all the required documents. You will also have to supply yours. You will probably be required to send in proof of your disability claim as well as the stubs (or proof) of what they pay you on a monthly basis. All assets and income should be reported and paperwork to back it up from both you and your co-sponsor.
