Former J-1 holder

Hey everyone!

 

There is a section that asks about having a previous J-1 exchange visa, and whether you completed the two year out of country requirement. My spouse had previous J-1 visas, but the last one was six years ago. This obviously meets the requirement, but do we need to provide proof of this? The stamp is in their old passport, which is overseas.

Timeline

If your spouse held a J-1, you should submit the form DS-2019 in your possession and a copy of the J-1 visa.

Now, there are two cases:

1) Was your spouse granted a waiver for the 2 years rules and it's clearly stated on the visa or on the DS-2019? You're okay (This was my case). 

2) Your spouse wasn't granted a waiver but he/she resided in the home country for at least 2 years after leaving the USA? Submit proof of this. I-94 with travelling history and proof of residence in the home country (lease documents, car insurance for example with translation if necessary.)

 

Be sure to explain this on your cover letter.
