You can use your W2s paired with your 1040 if you can't get your transcripts. But you should be able to get your tax transcripts for free off IRS website if you filed taxes for 2019

Our CR1 Journey:

 

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

Yea that’s the problem I didn’t file 2019. I learned that it’s a requirement for I-1864. Will it matter if you file and you set up a payment plan ?

Well, I864 aside, if you made $5 or more in 2019 (I hope you did) and are filing "married filing separately", or made $24,400 or more in 2019 and are filing "married filing jointly", you were required to file for IRS purposes. So I would amend your 2019 taxes with the IRS ASAP first of all. You'll need tax documentation for the I864 so use your W2s and fill out your amended 1040 (or whichever document you need for filing your taxes), make a photocopy of it for the NVC, and file those taxes

Thanks I was told I can’t file married filing jointly Because my spouse is out of the country and we couldn’t get the ITIN number. I would have to amend it once this entire process is over and he gets here

If you don't have an ITIN to file jointly then you have to file as married filing separately (you can't file as single it is illegal). You don't need to wait until he is here, you can file your taxes right now, as married filing separately. You print out your 1040 and write "NRA" where your spouse's SSN would usually go, and mail it to IRS. You need your tax documents for NVC and the interview so I wouldn't wait unless you're looking to hold up your process. You can amend it to MFJ once he's here, but for now, you need to file as MFS as soon as possible.

IRS website. You can also just use a free service like TurboTax to help fill out your 1040 for you, and then just print the completed form, write NRA for spouse SSN, and mail it to IRS, so you don't have to fill out the entire 1040 yourself. Since you've waited so long to file though, I'm not sure what the process is. Check out this link from IRS for more info on filing your taxes late https://www.irs.gov/businesses/small-businesses-self-employed/filing-past-due-tax-returns Either way, file asap as married filing separately by mail
