Divorce Apostilled Problem, please help.

Hello everyone, I hope someone could answer my problem because ive been looking answers people to people and also online but theres none. Anyway me and my fiancés problem is he is married in the Philippines but divorced in US. We met 3x now and apply for K1 Visa, my question is, Do you think the embassy will going to denied me during interview if he only have his divorce papers appostilled as record or he needs to wait for his divorce decree? I never been married. Thank you and Godbless!

He (USC) provided a copy of his divorce decree to USCIS with the I-129F?   Both of you must be free to marry at the time of filing the I-129F  < That is one of the requirements for filing the I-129F.

 

If the USC was divorced at the time of filing the I-129F the embassy doesn't care what Philippine records show.  You are not getting married in the Philippines so it is a moot topic.
