Hi, I have GC for last 6 years and in 2018 I was arrested for DUI. I was taken to the cell and kept for 4 hours and blood test was done. After paying the bond I was given court date. In 2019, court has reduced my charges to Reckless driving with 24 hour community service, probation until finish of community service. Now applying to Citizenship, some of the questions I have are,

1. Is my 4 hrs come as a Jail or Prison time? Should I say yes for Jail and prison question?

2. I have said said for arrest and probation and proving evidence of  arrest & charges report, court settlement report with probation officer information.

3. Any other documents that needs to be submitted?

Have any one of you faced similar issue?

Please Help :)

Answer 1, you will answer yes 1 day of jail.

2, your initial charge was for drink and driving 1 dui is not crime of moral turpitude even though it is reduce for reckless driving.

3, all the court disposition need to be submitted make sure they are copies if filing paper application. take original to the interview.

I am not sure if you have taken advice from immigration attorney or not but normally they advise to wait 3 or 5 years from completion of the probation based on how you got your Green card. You can still get naturalize but it is totally on immigration officers hand if applied within the statutory period. If i am you i would consult with an attorney before applying.
