Nope. because since she is going to live with me in couple's housing, then we need to file together to be considered for a couple's budget. That's why everything is so complicated.

Sounds like Rockefeller/NYU med student housing.

At the med school level you should be able to try a petition to the pertinent people at the school to explain the situation. At least in grad school I know the appropriate dean's offices handle requests that involve personal life decisions that affect the life/school balance. Specially in first years. Seriously, Harold... have you spoken/written the people in charge of those processes? Sometimes they can be much more flexible in what documentation they can accept given the tax circumstances. I mean... they can't control when their students marry... so there have to be alternate roads to moving students from single to married budgets and housing arrangements.

Yeah i've done that and you would be surprised. NYU med doesnt even offer incoming married students any housing (!!??) and as far as the people in charge yeah I've spoken to the head of the financial aid department and that's basically what they have told me. Messed up thing is that I do the hardest thing, which is actually getting into a top med school, just to find out that the housing is not even guaranteed for married students.

Charles, so my wife is eligible for a SSN as of now? We are waiting to get the EAD which will come in around mid april. I was under the notion that we needed the EAD to get the SSN since the K3 is a little different to the K1 in that regard. As far as speaking to the people in the IRS and Social Security, you are definitely right, they do not know much and I have yet to speak to the one that does lol. The only thing is that like you, we need the refund as well as the taxes filed ASAP because the financial aid packages and housing and all that stuff for medical students is basically first come first serve so have to be done with that quickly. Thanks a lot for the information.

Hal is right. You need the EAD first. I understood you to say that the IRS said your wife was eligible. That's the problem with believing everything the gov't bureaucRATS tell us. If she's NOT eligible, then there's no reason they should care about granting the ITIN. The difficulty there is that it does take some time. I don't recall off the top of my head how long it took us to get Lorena's, but I doubt you'd get it before the April 15 filing deadline.

Life will be a bit easier once she has the SSN. Taxes is just one example of how.

Hey guys,

I am in incredible disbelief right now... We just got an I-797C notice of action telling us to appear for an initial interview on Wednesday April 22, 2009!!. My main concern is the wording of the letter, could this be the letter to get the AOS approved? so soon!? If so that would be awesome. We received an email on March 10th, saying that the EA card production was ordered and it has not arrived yet. We applied early because we would think that it would take even longer and we might get the 10 year green card if the AOS was approved after August 18, the date of our 2nd year anniversary. Instead we get this lightning fast interview date. The letter says:

You are hereby notified to appear for the interview appointment as scheduled below, for the completion of your Application to Register Permanent Residence or Adjust Status (Form-I485) and any supporting applications or petitions. and on the top it says REQUEST FOR APPLICANT TO APPEAR FOR INITIAL INTERVIEW.

If anyone can please confirm that this is indeed the AOS regular interview I would greatly appreciate it.

P.D. I guess the FBI finally processed the fingerprints after a second try.

Wow Harold that sounds like an AOS interview. Looks like when they threw the applications down the stairs, yours fell on the top steps. I can't say for sure though, since we didn't have to interview the first time around.

How's the stuff with school going?

That was my exact reaction to when i saw the letter. But it looks like the people who sent the AOS packets around late 2008, early 2009 are getting interviews really really quick. Now i gotta start preparing all those papers that they tell us to bring in the letter.

The school stuff is going, still waiting to see what my financial aid packages will look like since i just recently submitted all the paperwork.
