Filipina Fiancee's Birth Date wrong when printed on NSO paper

My Filipina Fiancee (just had Petition approved by Vermont Service Center- I am the American Petitioner) from Ormoc City Leyte just told me there was a mistake when she had her Birth Certificate printed several years ago on NSO paper-they incorrectly indicated she was born in 1969 when her actual birth date and original birth certificate indicate she was born in 1971. She tells me she was told several years ago in order to correct this she must hire a lawyer and this could take a lot of time to correct. It would seem to me that if she went to register's office (or what ever the office is called where one can obtain the birth certificate printed on NSO paper) again with her original birth certificate, her current valid passport, her baptisimal papers all which show her correct date of birth, than they should be able to print this correctly. Any body have info relevent to this situtaion in the Philippines? Thanks, Rick

hello Rick2000, I also had a problem like yours, with my filipina fiance's birth cert having an error i was also told it can take alot of time and expense to change this. It is true! u will need a lawyer and a court/ goverment appearance is necessary. But be careful about choosing a lawyer in the philippines for this, i suggest having your fiance get this fixed on her own and without telling the lawyer why the birth cert is needed or that she has a foreigner fiancee. If not u could be showing them $ signs. But before doing this i would call the embassy in Manila and ask what they think about your situation, telling them your passport, i.d., and such is all correct, just the birth cert is wrong. They might have an easier solution to your problem.

october 29th 2003 - met Jenny on my first trip to Phils.

december 25th 2003 - visited Jenny again for Christmas :-)

feburary 23rd 2004 - visited once again :-P

may 23rd 2004 - visit again 4th time, stayed 3 months with my sweetie.

novem. 23rd 2004 - visit again, stay 3 months again.

may 26th 2005 - sent I-129f to USCIS

June 10th 2005 - recieved NOA1

august 28th 2005 - recieved NOA2

sept. 20th 2005 - Manila, Phils. embassy recieves our case.

novem. 23rd 2005 - visit my sweetie again :-)

january 10th 2006 - Recieve packet 3 from embassy

feb. 23rd 2006 - interview in Manila (both attended the interview) AR!!! march 17th 2006 - Visa in Hand! yaaaaaaaaeeeeh!

April 6th 2006 - Flight to the states.

July 26th 2007 - Filed for AOS

November ? 2007- RFE for tax papers

November ?2007 - sent in Tax Papers!

March 28th 2008 - RFE for Insufficient income need Co sponsor

June 27th 2008 - Send in Co sponsor papers

July 8th 2008 - RFE for Medical (TB testing redo)

August 8th 2008 - Card Production ordered.

QUALIFICATION TO ABOVE:Qualification to orginal post-Her recent NBI clearance has her

correct date of birth as well as her original certified birth certificate, and her valid passport all have the correct DOB-it is only when she has the birth certificate printed on NSO paper that the incorrect DOB shows. Does this mean that when someone coded info in to a computer system for birth certificates-they merely entered the wrong DOB?

The DOB on the NSO BC is what counts. That's the one the embassy wants to see for the visa application.
