cairo didnt approve the i-130

hello everyone

what a very sad day we had!! we went to the american embassy to file I-130 as DCF

we had about 3 interveiws and mannnnnnnnnny question

then they said we didnt approve this petition and we will send it to the homeland security n athens embassy

im very depressed about this and dont know what s the homeland security and why athens embassy ?

and they didnt ask for any evidence although we have mannnnnnny pics and shared bank account and many mails ........etc

plz do anyone anything about this plz

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

yes i did and we write it n the forms and the emplyee didnt accept the petition then we told her we need to meet the consular and we met him ,discused about travelling and showed him the work visa i have to saudi arabia and i dont have time to come back again and he accepted

07.24.2007 - Mailed in AOS & EAD together to Chicago

The USCIS field office that services Egypt is located in Athens. The consulate in Cairo apparently does not feel comfortable processing your petition, they want the USCIS to process it.

I am so sorry to hear of your situation. Cairo is not a fair embassy to deal with. Who was the CO you met with? I doubt they gave you a name, but what did they look like?

There was another forum member who filed DCF in Cairo and had their petition sent to Athens USCIS. I'm sorry I don't remember their name but this is not good news. Our case was returned by Cairo, but it was originally filed in the US and it was sent back to the Service Center even though Cairo told us it was sent to Athens. For DCF, it will usually be dealt with in Athens since you didn't originally file the petition stateside.

They should have given you a paper stating 221g and a reason they were not approving you. I would recommend escalating it, have your wife contact the Immigrant Visa Chief (if there is one there now) or the Ambassador's office on the US citizen side. Explain what happened and see if they will help allow you to present your case. Usually, Cairo doesn't immediately send the case off, even though they say they do. However, if they have, they usually won't do anything until they hear back from USCIS.

Have your wife contact her Senator's office from the state she last lived if she has been living in Egypt. They will ask her to sign a paper to give them permission to check on the case. Ask them to look into it, tell them all that happened and ask if they can help you to get the case back on track. At the worst case, they should be able to find out where your case is and what the reasons the CO is using to deny it.

I agree Cairo is getting more difficult to deal with. I just wanted to say that i hope all goes well, there were some great suggestions from blueblue on what you need to do. I hate :angry: to see people go through so much to have to have thier petitions sent back its just not right . But i know that you will both get through this, I wish you both all the best, and everything will be ok don't give up you will be in my prayers. (F)

12/21/2006--Cairo Embassy recieved packet 3.

2/21/2007---Packet 4 recieved.

3/12/2007---Interview (He Passed)!

3/12/2007---Administrative Processing begins.............God please help me get through this!

7/17/2007---Our 2 Year Anniversay!!!

10/23/2007--7 months and 2 weeks of A/P and still waiting..........God help me!

4/22/2008---2nd Interview ( keep us in your prayers)

4/22/2008--He was approved for the Visa 2-3 weeks until he recieves it in the mail lets hope so!!

6/03/2008--VISA IN HAND! Thank you god!

but really i dont know what s up with them ? we didnt do anything illegal

we lived together here for more than 6 months together to apply for this DCF and we didnt know that this thing will happen to us

we r gonna message the consular but i dont know maybe the guy we met s the consular. they were 2 guys one s fat and has white skin and the other was black and tiny

so we may send the embasedor too

we really dont have time bcz we have to travel as soon as possible and if we went out the country we have to reside another 6 months . im sure that they r playing with card

Correct. There hasn't even been a visa application yet for the consulate to deny.

A consulate can accept and process petitions if they feel comfortable doing so, but if for any reason they do not feel comfortable the approval of petitions is a USCIS responsibility. And since the Adam Walsh act there is an aspect of the petition that must be reviewed and approved by USCIS in all cases anyway, so it is understandable that a consulate might prefer to have USCIS take care of all aspects of the petition.

07/22/07 - interview consular never bothered to show up for work.
