Hi all, hope to have some advice from anyone here. Thanks in advance!

 

I am US citizen and moved to HK over 10 years ago, worked until 2012 after move in to my fiancé apartment. I haven’t work since 2012 to present, partial financial support from him. We went to visit my parents in US last year as we are thinking to move back for permanent stay. Now we are thinking to file K1 for my fiancé. 

 

I owned a townhome in US with mortgage loans. My parents are staying there and their monthly rental income will settle my mortgage payment.

 

Questions are :

1. As noted from the I-129F form, there is section asking the employment status, but I haven’t work the pass 5 years, should I leave empty? As I worry I do not have financial support for my fiancé and end up the immigration department will decline my application.

 

2. If I am lucky enough to pass the application from USCIS, given I do not have strong financial profile, is it possible to have my parents be the co-sponsor with affidavit of support? Their annual income around USD100k.

 

Does anyone come across similar situation before? Please kindly advise or provide any suggestions  🙏🏻

 

Anyone can tell me the different between filing process of K1 / spouse immigration?

If you are currently living together I would question the logic of the K-1 visa. It’s more expensive, takes longer for your fiancé to become an LPR and puts your fiancé in limbo status for months upon arrival without work or overseas travel (and possibly without being able to drive, depending on the state where you choose to live). 

 

Get married now - anywhere in the world - and file for a spousal visa and your then-spouse will be able to work immediately and will be an LPR with full status as soon as you arrive. 

 

You would need a joint sponsor unless you return here ahead of your spouse and start working. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
