Hi All,

If someone is reading this (and I thank you for reading this) I would just like to know if I am getting impatient or need to take action. I've called and emailed about 15 times throughout this process and I just got tired of being put on hold for hours without any clear response from USCIS, NVC, and US Embassy. I don't know where else to turn with these matters and anything would help.

 

This is the history behind our case. I sent this case in August 29, 2017

Submission of I-129F from California: 8/29/17

Received our First I-797 Notice of Action : 2/22/18 (NOA 1) approval from 2/22/18 to 6/21/18

Received NVC notice of approved I-129F and Obtained a NVC Case Number: 04/08/18 

06/11/18: Beneficiary attended her interview at the US Embassy in Tokyo

06/13/18: US Embassy in Tokyo email stated the Visa application is permitted, however the case is still listed as Pending

06/26/18: Next email received states there's additional processing needed and to please cancel any flights planned

07/02/18: Next email states the case went back to USCIS, NVC for additional procedures. Passport will be returned once processing is completed: 07/02/18

07/23/18: Received another NOA in the mail stated approved petition from 7/17/18 -11/6/18 (NOA 2??)

07/23/18: Next email says our case completed processing at NVC and sent back to the US Embassy in Tokyo

08/14/18: US Embassy states they haven't received the case back from USCIS viaNVC.

09/24/18: US Embassy in Tokyo states our I-129F petition has expired. They now request a letter of re-validation to continue the case for an additional four months.

 

I don't understand why our NOA 2 arrived so late during the process, but there hasn't been one explanation or correction noted during this process.. Should I get a lawyer involved at this point to help me get this approval? I can't get a single answer from the USCIS, NVC, or US Embassy in Tokyo on where our paperwork is at and what the next step is. She has submitted her passport along with her paperwork back in June, and haven't received it back yet. 
If anyone can help with the situation that would be great. We are holding on the best we can, but this has been a rough experience.

I would try to one more time contact the:

- Embassy in Tokyo - ask for an explanation of the grounds for the expiration of the petition, withholding the passport and clear guidelines on what to do next;

- NVC - ask for clear explanation of your situation, remind about withholding the passport;

 

With every data collected I would contact your Congressman, Ombudsman and an immigration lawyer.
