Hello VJ. I recently recived a request for evidence letter from uscis due to I-846 revision no longer valid..

 They are now asking I-864, Affidavit of support revision date 3/06/2018 which I printed and filled out.

They are also asking for my tax return for most recent year which I assume is 2017. My tax return was olny 21k last year but I have 4 dependents.

My question is do I need to resubmit all evidence of assets? I already submitted my deeds and appraisal for my rental properties, 401k statement bank statements and ira balance when I first applied. Do I need to resubmit all evidence again? Or just my most recent tax return that they are asking? Not sure if they will have all evidence when they relook into my case. I called uscis and they said I should resubmit all evidence not just last year tax return. And they also requested evidence for my I-765 for a second time due to my wife not answering the 1st question on the form. She filled out the form again completely and resent it but got a letter today stating she needs a I-485 receipt (I-797) which she has but they never asked for it with the request for evidence. So I can send both request for evidence at the same time to same address correct? And should I summit all evidence again? Last question my current income is last year tax return number or what I’m expecting to make for 2018.. thank you for the help any advice will help to avoid another request for evidence. This is my second wife I’m sponsoring my 1st wife divorce me maybe this why it so much harder this time around. The 1st time I didn’t have to resubmit anything,,,

1. USCIS said you should resubmit all evidence - not just last year's tax return. - Self-explanatory

2. Page 23 of 27 of the I-765 instructions states

12. (c)(9) or (c)(16) Any current Adjustment of Status or Registry applicant who filed Form I-485 on or after July 30, 2007, and paid the appropriate Form I-485 filing fee. If you file Form I-765 separately from your Form I-485, you must also submit a copy of your Form I-797C Notice for Form I-485, as evidence of filing Form I-485 on or after July 30, 2007, and payment of the appropriate filing fee. If you did not pay the appropriate Form I-485 filing fee because your filing fee was waived or you are exempt from paying it, you must pay the Form I-765 filing fee or request that the filing fee be waived; [...]

 

Current income is what you have earned so far in 2018 PLUS a projection of what you are expecting to earn by 12-31-18. 

 

 

I-751 Joint Filing.

06-15-2021 - Case was updated to show fingerprints were taken. 

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.
