I'm USC, fiancee' is Canadian who drives truck out of Windsor, crossing into US almost daily. We rec'd NOA2, and r wondering if there's ANY WAY he can continue to work out of Windsor after we're married (while we're waiting on the AOS?) :help:

No, if cross back into Canada they will need to apply for new visa K-1 is a single use visa.

K-3 may be a better visa in this situation it is a multi entry visa, marry first, then apply for visa.

It would be, perhaps, foolish to start over again from scratch, wouldn't it?

I would contact a qualified immigration attorney and find out what your options are. You can't be the first US/Canadian couple to face this kind of situation. There could quite likely be a solution in place already for those in your situation.

I'm sorry but the answer if you do a K-1 is no, no way around it. The K-1 is a single entry VISA. Your fiancee will need AP (advanced parole) in order to leave and enter the country if you go down the K-1 Visa route. I would carefully look at all the VISAs and see how they apply to your situation and decide which is the best. Read the guides and forums here would be the first thing to do.

I never said that. But she said she has her NOA2 already. He wants to work in Canada while living in the US? Might affect the PR status if he spends more time in Canada than the US. Who knows, I'm just saying it needs to be looked into.

Isn't the point of applying for a K1 to come live in the US, not the US & Canada?

It's not a question of living, it's a question of continuing a job in a border town. You can see Windsor from Detroit, as I recall. They are just a bridge apart.

Right, that's what I was saying from the start, but you didn't imply much past it being "unlikely" that there was another option. But neither you nor I know, and we agree that she needs to research more, so that's settled.

The answer is simple, if they went down the K-1 route he is going to need AP in order to travel back and forth, otherwise once he enters the US he will NOT be able to re-entry. K-1 is a SINGLE entry visa.

Plain as day read the paperwork.

It probably won't affect his PR status at all. Lots of people live in the US and commute to work in Canada and vice versa. So much so that US/Canada customs have special lanes (NEXUS) for frequent commuters such as them.

Your best bet may be to go the K3 or CR-1 route. I went the CR-1 as I will be commuting to Canada to work. I didn't want to mess around with the AP. If I hadn't had to reschedule my appointment I would have things completed in less than a year - Filed in Feb and had interview in Dec.

Holy mackeral, didn't mean to start a debate :rolleyes: but my utmost thanks to you all! I learned ALOT.

To clarify, we already filed K-1 and rec'd NOA2. He is a truck driver who's standard route is Windsor to Chicago, with a stop in Michigan (me!) when he can manage. He's been w/his company several years, has a great boss/pension/team, and when he becomes PR, offers an opportunity for the company to run US runs w/o having to go thru Canada. SO, living in US while based out of Windsor does have it's advantages, and many folks travel the bridge daily to and from work.

Is the C-1 applicable only to us if we are married?
