I need help with an I360 Widower process.  I am helping a friend who is Pinoy and her American Husband passed away last month. They did not file an I130 or any paperwork.  I am trying to find the exact process for the Windower to file. They were legally married well before he passed away.  I see that the I360 needs to be filed, but I am sure there is some other form.  Does it follow the normal I129 process for overseas petitioner?  Please let me know so I can assist my friend with this.  I cannot find a definiate answer or forum that addresses I360 stuff.

if I am reading this correctly, then the I360 is the only form need filed, but must be accompanied by the following:

You must file the petition with:
1. A copy of your marriage certificate to the U.S. citizen and proof of termination of any prior marriages for either of
you;
2. Copies of evidence that your spouse was a U.S. citizen, such as a birth certificate, if he or she was born in the United
States or a Naturalization Certificate or Certificate of Citizenship issued by USCIS; Form FS-240, Report of Birth
Abroad of a Citizen of the United States; or a U.S. passport that was valid at the time of the citizen’s death; and
3. A copy of the death certificate of your U.S. citizen spouse.

 

Just cant believe this is all thats needed
