ROC LOANS AND SUCH

So, I have a stepson aged 21 waiting to apply for federal student loans living at home with me. My wife will co-sign the application with him (or some form of student loan). He is currently working and I dont intend claiming him on taxes, he is however part of the household. My wife is concerned this could potentially affect my ROC green card application or N400 in the future. The reason being the new proposals by trump and general worrying. I guess I am asking if this will affect my application? 

 

I dont believe it will as that would seem insane, but you never know these days.

Is your wife concerned that student loans would be considered a "means tested benefit?" If so, don't worry - 

1. Since they are loans and need to be paid back, they don't qualify as "assistance" in that way.
2. Since your stepson is (I presume) a USC, he qualifies. Your immigration status doesn't impact that in any way. He's getting the loan, you're not.
3. Even if 45 decided to disqualify everyone related to an immigrant for federal student loans/student aid, he most likely would not be able to make such a ruling retroactive. (Which means that, if you'd already gotten aid, it couldn't be held against you, but you wouldn't qualify going forward.) This would make him mad, but the rest of the government just wouldn't stand for it.

It's to my understanding: and you can read the larger discussion on the new policy on the forum - that what the administration will be focusing on is those who are A) applying for a visa and B) applying for adjustment of status. These two criteria has to meet a public charge test to pass. ROC and becoming a citizen are not examples where a public charge test is considered so none of the new policy stuff for now should apply. While I have serious concerns about the new policy's unconstitutional punishments on USCs and their immigrant relations - this should not for now pose any threat to your ROC application whatsoever.
