Hi Community, 

I need your advise about a complicated situation.

 

1- I got a J-1 visa with 2-years rule applied in 2016 for 1 year and I have been working as a visiting scholar in a university in US for 2 years.

2- Recently, my DS-2019 was extended by the university for 1 more year till january 2019.

3- At the same time, I received permission letter for staying US till 2019 from my institution in home-country.

4- For some reason I need to visit my home country and to stay there at least 1 month, then I am planning to come back US to complete my research project in the university till the end of date permitted by both side.

5- By the time I am planning to go to home country alone by leaving my family in US due to expensive flight tickets.

 

Do you think it could be any problem when I am reapplying to J-1 visa because of 2-years rule although I have valid permission from my country and the university in US (DS2019)?      

 

If you have any suggestion, please let me know.

You cannot reapply for J1 visa. You can extend a J1 visa by extending the DS 2019. 

 

Are you asking about getting the actual stamp on the passport so that you can enter to the US? You would be asking for a J1 renewal because you are under the same DS 2019. That is different than applying for a new J1.

No problem. It is a common issue. 

 

Some consulates, when dealing with a renewal, do not require interview. Other consulates still require the interview. It varies so check out the process in yours. I think you'll be OK.
