Hello Guys,

 

I filed for adjustment of status but was denied. 

 

before the denial i got a notice, requesting for additional evident which i mistakenly sent the wrong ones yet. the following was the decision.

 

You failed to submit:

 

Evidence of assets that meet the federal poverty line or obtain a joint sponsor.

 

As you have submitted a partial response, you have requested a decision based on the record.

 

Title 8, Code of Federal Regulations, §103.2(b) states:

 

(1 4 ) Effect of request for decision. Where an applicant or petitioner does not submit all

 

re q u e ste d additional evidence and requests a decision based on the evidence already

 

submitted, a decision shall be issued based on the record. Failure to submit requested

 

evidence which precludes a material line of inquiry shall be grounds for denying the

 

application or petition.

 

You have failed to establish your eligibility for the benefit sought. Accordingly, the application

 

mu st be, and hereby is, denied.

 

USCIS has determined that any pending ancillary Application for Employment Authorization, Form

 

1-765, and/or Application for Travel Document, Form I-131, related to the Form 1-485 are also

 

denied. Any Employment Authorization Document and/or Travel Document already approved

 

based upon your pending Form 1-485 are hereby revoked.

 

There is no appeal to this decision. However, if you are placed in removal proceedings, you may be

 

able to renew this application in such proceedings before an Immigration Judge. Furthermore, this

 

decision is without prejudice to future applications filed with the appropriate USCIS office.

 

If you desire to file a motion, you must do so on Form I-290B within 30 days from the date of this

notice (33 days if this notice was received by mail). The motion shall be filed on Form I-290B,

 

together with the current fee and mailed to:

What would be my best short at this time? i have all documents ready. i was wonder if i could make a new application since the decision made was without prejudice. or should i file a motion to reconsider?

AOS based on what? K-1 or you had another visa? 

 

This was rightfully denied. You didn't provide what they asked for and they adjudicated accordingly. 

 

Compile everything again including the part you missed the first time (I-864) and file again. Yes, you'll have to pay new fees. 

 

No, I-290b won't work for you - that would be waste of time and money to get a denial.

i came in on F-1 but married and filed I-485. do u have any idea how long i need to wait to apply all over again? can i apply right away?

No wait time but be smart and this time follow the guide (top of the page guides tab) to make sure you're not missing anything. 

 

Spouse filed I-130 for you with I-485? Include NoA1 with I-485.

it was just I-864 for my wife that i didn't send. i'll have everything in place this time. i'm glad u showed concerns, thanks a lot.
