One of my friends was included on a petition for her mother, that was submitted in 1997.  Her mother passed away a few years ago and she has also aged out.  She tried to apply for a tourist visa recently, as she didn't realize the petition was still active. She was told by the consulate to have her petition canceled before she can apply for the tourist visa.  She no longer wants to immigrate, as she has a family now and is happy living and working in the UAE.  

 

How does she get that immigration petition canceled?

Green Card Process Summary
3/25/2013 - Submitted I-130's
01/13/2014 - Embassy Interview - Approved!
05/28/2014 - POE (U.S. Customs and Immigration Overseas Preclearance Facility - Abu Dhabi)
08/20/2014 - Green Card received.

Naturalization Process

01/20/2015 - Submitted N-400 for immediate naturalization under INA 319b.

02/10/2015 - Check cashed.

02/14/2015 - NOA

04/07/2015 - Case shipped to local field office.

04/08/2015 - Interview scheduled for July 6, 2015.

04/08/2015 - Wifey better be studying her butt off for the citizenship test!

07/08/2015 - Wifey was studying her butt off and passed the test easily. Oath ceremony completed on same day! We are done with our journey!

Having a petition does not prevent you from getting a visitors Visa. I have an F1 petition with priority date April 2011, and i was able to get a 10 year B1/B2 visa in August 2015. I have travelled on this visa many times, no problems.

You are one of the lucky one. I went to renew my visitor visa and was denied and my nephew went and was told his mother was been  petitioned. Evert case is different.

See if she can get the case number and email nvc about it

I guess i was lucky. I know of many others in my position here in Jamaica who got 10 years multi entry B visas with an existing petition. It shouldn't be a problem because violating the visa would negatively impact the petition.
