Hi all. Need some advice. I am a US citizen who has lived in the UK all my life apart from 3 months in 2009 when I lived with my dad and worked for a bit. I am now looking to emigrate with my daughter and husband next year after we marry. I have already sent off my daughters i130 which was approved and sent back within the week (here in the uk from the embassy). I have now also submitted the d260 in the last week but not heard anything about booking a medical or interview as of yet. I have all the documentation that I need together however the i864 has got me stumped. Firstly I have never submitted US tax returns as I've lived and worked and paid taxes in the UK all my life (apart from those 3 months). Secondly I'm giving up my job as will my husband for us to move over. My dad who we are initially going to live with is going to be a joint sponsor and submit an i864 also but just filling the form is so confusing and Im not sure of we're filling them in correctly. Also we can't start any of this process for my husband until April 18 after we get married and my dad will have to submit another i864 for my husband, I'm assuming he has to state on the form he is also sponsoring my daughter? Any advice on how to correctly filll in this form as the sponsor and joint sponsor will be greatly appreciated.

 

I have my social security number and card. Am opening a US bank account. Have a letter from my parents stating that we will live with them. A valied  US passport. Will be enrolling my daughter in school for the new school year when we are over for the wedding. Anything else I can do to show my intention to re- established domicile in the US? I have read that for US citizens living abroad returning to the US they will take the i864 on "good faith" as.long as show intent to re establish domicile??? Something along g those lines. I'd just hate to go through this how who process and expense to get pulled up here.

Start by becoming an A student of the I-864 instructions.  Because your daughter will become a US Citizen automatically, once she uses her IR2 visa to enter the US, she is exempt from needing an affidavit of support.  File an I-864W for her.  

 

The mistake you have made or will make if you go through with it is to get your daughter's visa so far in advance of when your husband will have one.  Her visa will expire in six months.  If she doesn't immigrate to the US WITH YOU, before it expires, you've wasted your time.  Just delay further processing, medical exam or interview for her to avoid her visa expiring before you are ready for her to use it.
