i29f question for part 2 38.-38h

I have a question about part 2 question 38-38h, and I find contradictory info on it everywhere. The question asks if the beneficiary is currently in the US..... but then the instructions say "If beneficiary has ever been in the US...." My fiancee was in the US for work 3-5 years ago, we did not know each other at the time. My question is, do I still need to fill out this section and attach the i94, passport stamps, etc if she is not currently here? 

 

If so, I will go ahead and ask now if I should attach copies of her current and her old passport (her old passport still shows it is not expired by date, but apparently there was a change in the passports in the country, so she had to replace it and the old one says annulled)

 

Any help would be appreciated,

Items 37 and 38 are not related. If she's not in the US currently/at the point of filing, you do not need to complete Item 38.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.
