Our attorney has filed a petition on behalf of my husband (petitioner, US citizen) and me (EU national) with the USCIS on November 23, 2016. We received the approval letter for the form I-130 on July 12, 2017. The issue is that on the approved letter is written that the “beneficiary is in the United States and wishes to apply for adjustment of status” and requires us to fill the I-485 form out. As I’m living outside the US and this is a mess up done by our attorney, we would like to know how to proceed. We fall in the category “immediate relative OUTSIDE the US” and not “the adjustment of status” or “immediate relative inside the US”.

Right from the start, we have requested to have the interview at the US Embassy in my home country, so we are surprised by this outcome. According to our understanding our only option is to fill out form I-824 but that is an additional delay of at least 120 days and a fee of 465 USD or do we have other options? We don’t know how to approach the situation.

Can we contact USCIS and NVC directly as we don’t trust our attorney anymore?

Can we request to expedite since this wasn't our mistake but it was the negligence of our attorney?
