My Taxes are a MESS--Help!

Hey everyone,

We recently got our NOA 2!!! Yaaaaay! (I have to update my timelines etc. :whistle: )

We're really excited to hear from the Visa Center. However, I'm really worried about my taxes....I have a tax return for 2014, however, I'm confused about what to do for the other two most recent years. 

2015 - I had no income and was living overseas in Peru. I never filed taxes for that year. (Not sure if this is pertinent information but my husband and I got married in December 2015). 

 

2016 - I had a total yearly income of just over $4,000 with a 1099-MISC. Was also living in Peru. I didn't file because...well, that's not a lot of money so I didn't think I qualified to file. I tried to file online but didn't know how to deal with the question of should I file as single or married filing separately. 

The good news: My parents are willing to provide the financial affidavit. Together, they make the necessary income to be able to be considered as providing financially for us. 

So, what should I do? These are what I see as my options:

 

1) Late file my 2015 taxes as 0 income, and file my 2016 taxes ASAP (I still have until June 15, since I'm living overseas). [] Lingering question there: Do I file as single or married filing separately??

2) Not file my 2015 taxes, but file my 2016 taxes. 

3) Not file either one, write a letter about the situation explaining what happened in 2015 and 2016, and hope that they focus mostly on the fact that my parents are offering support? [] If I wrote such a letter, would it have to be notarized in the U.S? Or would a Peruvian notary count? 

Has anyone been through anything like this?? Please help!

Filed: Timeline

You do not need to file a tax return for 2015 since you had no income.

 

File your 2016 income tax as married filing separately.  You were not single in 2016.

 

In your letter, you would need to assert that you were not obligated not to file.  You can't do that since you are obligated to file in 2016.

After filing 2016, One Year 2016 Tax Returns  and find Job for good salary ..

Current Employment Letter with  Pay stubs ,You can Submit All Required Docs to NVC.

File your taxes and write a letter of explanation, you have to file single because not in same country, if your in the USA and spouse somewhere else they don't have SS card, if you put married they ask questions about them and request SS number. If you have a sponsor your taxes don't apply only the sponsor have to send taxes with the Affidavit of Support.

I should clarify that my parents are going to sponsor us, that's what I meant by this:
