Hello! I've been helping my dad with his naturalization application, and there are a few things that I'm concerned about. He's lived in America as a legal permanent resident for nearly 40 years now, so I'm probably worried about nothing but I just want to make sure I get everything right.

 

First, my dad committed a crime in 1988. It was a nonviolent class 4 felony that they lowered to a misdemeanor. He was sentenced to probation, and they ended the probation early for good behavior. We recently got the entire case file for the whole ordeal (which basically lasted from 1988-1995 as far as court documentation goes), and from what I understand, there are certain photocopies that we should be sending in with the N400? If the answer is yes, then we move on to my second concern.

 

I found a motion from my dad's lawyer titled: Petition for Judicial Recommendation Against Deportation and Exclusion. There was a reply from a lawyer for the U.S. Immigration and Naturalization Services who motioned for the petition to be denied. There is a very short page with a minutes briefing that states that the motion was denied. Does anyone have any experience with this petition and what a denial of the petition means? My dad's still here so obviously he wasn't deported. Should I also send copies of both motions and the conclusion in with the N400?

With any criminal problems or past with immigration it's always best to consult a law expect first. He should be fine but you never know. Immigration is so strict these days. I was denied my citizenship just because of an old address that was still on my w2. I filled under the three year marriage rule. With a criminal past dont just assume that immigration will just forgive just like that.
