How long does it take to get the I-797 after the Biometrics? Less than 3 weeks I hope, DMV makes some trouble about my dl....

Are you talking about your interview letter?

IF you are, that is an I-797C...but ours arrived two weeks BEFORE biometrics. Even if you're talking about something else, you can't get a strict answer. For some people it's two months, for some people it's not. Etc etc.

The lady at the DMV office told me I should get an I-797 after the Biometrics, she couldn't use my I-797C (NOA) for my dl. She just said it almost look the same like the I-797C but there is some sort of stamp on the bottom of it...

This is the only thing I found for I-797 that has anything to do with marriage based AOS ( http://usaimmigrationattorney.com/images/RecordTimeI-797.gif ) but that's for an I-130 which you would not have filed since you're on K1.

The Colorado DMV has this to say pertaining to non US Citizens, as far as what is needed as proof of legal presence:

Valid foreign passport when accompanied by one of the following additional documents:

I-94 stamped with “processed for I-551.”

Attached unexpired temporary I-551 visa .

I-94 with status which authorizes residency, employment or education within the United States. This document must be accompanied by any required supporting documentation in accordance with the status descriptions established by the Department of Homeland Security.

I-94 with Refugee or Asylee status.

Valid I-551 Resident Alien or Permanent Resident Card. Border Crosser cards and USA B1/B2 Visa/BCC cards are NOT acceptable.

Valid I-766, I-688A, I-688B photo Employment Authorization card or I-688 photo Temporary Resident card.

Honestly, I'd go to another DMV and see what they tell you. It doesn't sound like you'll have too much luck, but the site says nothing about an I-797 so I'm confused as to what she might have meant. If they tell you the same thing, request to see one or have them explain exactly what it is so maybe you can get more help on here .

All letters that I have gotten are NOA and therefore I-797C. When I went yesterday to my local DMV they only looked at my initial NOA that was my receipt notice. They needed that for my A# and to give me a DL that was valid only for a year after their received date. Good luck,

Jun 28, 2012... Placed in line for interview scheduling Day 28

Jul 20, 2012... Email from USCIS London for info to schedule interview Day 50

Sep 1, 2012... Moved back to the USA

Sep 12, 2012... Email from USCIS London scheduled for interview/oath Sept 28th in the UK(will be day 120)

Nov 26, 2012... Had submitted change of addresses. Notification that I have again been scheduled for interview Day 179

Dec 1, 2012... Letter arrived Day 184 with new interview date Jan 4, 2013 (Will be day 218)

Just to remind people that there is no point giving your experience with DMV matters unless you have experience with the DMV in the same state as the original poster. Stormnrolly - the Arizona DMV most likely has different requirements to the Colorado one. From meow_mix's post it sounds like people in Colorado are out of luck unless they have a green card or EAD.

That's what I was thinking...the I-797 is used for everything they communicate - they received it, biometrics appt, interview appt ... if that's that case (which is in line for what their DMV site says) and they want the welcome letter, they want to know you've been approved, which is doubtful as far as coming in 3 weeks after biometrics.

It's also all up to the representative you get at the DMV. My husband got his DL with his NOA1, which is not common for Florida, so there's no reason to think that's the rule. You're at the mercy of the available employee who takes care of you, really.

What action type are you asking about?

Hi I just received a I-797C to capture my biometrics. What is that means? I already had taking finger printing a while back like in the middle application of I485. Why do they need them again? What happens after the biometrics and what happens during the biometrics appointment. I just receive a DWI will that interfere with my biometrics appointment or after? thank you so much.
