Help filling out i-134 when earning foreign income

I, the USC, have been living and working in Mexico since 2010. I earn a peso salary (local currency for a Mexican company) and will be using my father as the co sponsor when the time comes. We are still waiting for the NOA1, but because of my situation I want to start filling out this form so I make sure I have everything I need to pass to my fiancé for the interview. PLEASE, if anyone has been in the same situation as me, can help me fill out the details, or what I need to get from my employer here, it would be helpful. I earn below the IRS converted USD yearly salary to have to file taxes. 

 

I really appreciate any help as I knew from the start this would be the thorn in my side.

Hi there, me again lol

 

So I'll preface by saying I personally have not been in the same situation but I can at least give you some advise...

 

First off, you as the U.S. Citizen will always be the main sponsor, whether or not you pass the income poverty guidelines. So you will fill out the I-134 as normal and attach the supporting backup that goes along with it. Second, Juarez I believe does accept co-sponsors so you will have your father do exactly the same as you did and fill out Form I-134 and also attach all the supporting backup for himself.

 

The employer letter is simply a letter from the employer confirming your employment, such as: job title, tenure, f/t or p/t status and most importantly annual salary info. The rest of the supporting backup is easy: pay stubs and income tax returns or transcripts.

 

In reference to not filing taxes... A U.S. Citizen living outside the U.S. doesn't exempt you from filing a tax return. However, being under the tax filing requirement will qualify as a reason to not have done so. I would prepare and write up a statement (basic letter format) confirming that information because they will be looking for a tax return otherwise. Something simple, such as this:

 

As per IRS law regarding Tax Year XXXX, an individual with income less than $XXXX per year is not required to file a tax return. My taxable income was $XXXX, which is less than the amount required for filing a tax return.

 

Don't forget to add a signature line & date at the close of the statement suggested above.

Totally just seeing this Maria! Thank you so much for your help...like always. I think I need to contact you directly as you are the only one that answers any of my inquiries. 

 

I have requested from my job, a letter for years 2014 through now (all separate) detailing who I am and how much I have made each year. I will then have them translated (even-though translations aren't needed at the interview if in English or official language of that country) and on the line that states income. I will put the closest thing to the conversion to dollars. My salary has never changed since I started here, so they will see that each year I was under the required amount to do taxes. I will also write the letter as you suggest, detailing all of this. I do not get a pay stub. The Pagadora transfers the same amount to my bank account every 2 weeks. I can print out as many of those as I can. Maybe I will stat now since I can only go back so far. 

 

You're a doll... and I so appreciate your help. Btw... I knew I would never receive the NOA1. It's been 4 weeks. I will call USCIS on Monday at they said to call after March 11th if nothing is received. I hope I can give a backup address for the NOA2.

When you call in, call early morning and ask for a supervisor (Tier 2). They will try and steer you away from that, however, be a little insistent but polite ;) You want a supervisor because you'll want to try and plead your case to have the supervisor email you a copy of those notices and explain how the mail system is not the best and you haven't received anything and don't think you will so that's why you're asking for an email copy. They should have your email in the system from your application so it's not like you're asking them to email you at a different email. Plead your case, be insistent and most of all be very polite with your "demands" lol :thumbs:

That is great advice! Thank you. I will definitely do that. Or at least be able to have it sent to my dad's address (where we will be moving too) and he can fed ex it to me. I'll let you know how it goes :)
