Good Evening! 

 

I had 2 questions regarding the K-1 Visa petition. 

 

1) I am an incoming dental student to MWU in Glendale, Arizona. I am the petitioner, having been born in the US. My fiance is from Canada and we live very close (I'm in the upper peninsula of Michigan). I currently do not make enough to legally support him, even though he plans on finding work and I will be taking out federal loans for school. My mother has therefore filled out an I-134 Affidavit of Support since she has the funds to technically support him in the event of him needing it (although we likely won't). Do both my mother AND I need to fill out one of these forms even though only she likely meets the requirements for support? (I work as a waiter at a local restaurant)

 

2) On question 38 it asks if the sponsor intends / doesn't intend to make specific contributions to the person of support. Since she doesn't plan on it, should my mother check yes or no? And If I need to fill one out too, I'd check "no" then, correct? Thanks for any help you can offer!

Timeline

The affidavits are needed only at the interview stage, not with the initial petition.

 

1) You both need to fill out a form. You, as the petitioner, will always be the primary sponsor (regardless of your financial situation).

 

2) Do NOT check no. Check either YES or write N/A. Remember that this form is used for multiple purposes (not only the K1), that's why many will say that the most appropriate is N/A. No is not appropriate, and one persons affidavit was denied for that reason.

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

 

ROC process:

11/3/2018: ROC window opens
