Am I correct that the US petitioner need only submit their docs? When the alien fiance/e is submitting the K! theirs are required?

I ask as we are awaiting my divorce decree next month but my US fiance could start his end of the paperwork now?

 

Also on 1-129F it asks date marriage ends. I wish to give the date I legally separated from my ex husband. Is this correct?

Or are they looking for date of divorce?

Sorry, no, that's not right.  The petition cannot be filed until both of you are legallyable to marry, so you have to wait for your divorce tobefinal.  You each have to submit a statement with the petition to that effect (i.e., that you are legally free to  marry) and you will need to include a copy of the divorce with it. Check out the guide at the top of the page for the other beneficiary documents/information that need to be included with the peition.

And, the date the marriage endsis the date of the final divorce decree.

Divorce finalized.  A legal separation does not end the marriage -- it only separates the two parties for certain purposes without ending the marriage.
