Morning everyone! 

 

I filed for my cr1 visa and it was received at the USCIS London office on the 14th December (NOA1). Now I am still currently waiting for my NOA2 but my question was, can my wife move back to the states with our son while my CR1 is still being processed? Obviously noticing the USCIS office of change of address.

 

Our plan was to go out there in April together, I would visit on a tourist visa and return to the UK to work until my visa is finalised, and she would stay out until I can move out to the states on a permanent basis. 

Have read many conflicting reports so anyone with any experience of this would be a great help!

Yes that is fine; as soon as the I-130 is filed vua DCF, the petitioner can move back.  Some couples prefer to wait until the I-130 is approved, just in case there is a initial denial and then DCF is no longer an option if the petitioner already moved back, but if you filled in your paperwork correctly, that is very unlikely,.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
