Reneweing EAD while AOS Pending

Timeline

I am wondering if there is an actual USCIS document that states that EAD can be renewed while AOS is pending. I know that it should be o.k. as long as I apply 3 months prior to EAD expiring. The reason I am asking is that I am about to be hired and the employer might be concerned about EAD expiring in Jan 2008. I think they would be more comfortable hiring me if I show them that my EAD can be renewed. I am stuck in FBI namecheck and that can take a while, so I have to be prepeared to renew my EAD.

Any help is appreciated.

the verbiage on the I765 is probably all you would need to prove eligibility for renewal. I found this on page 2 of the I765 instructions. A family based adjustee category is eligible.

Definitions

Renewal EAD: an EAD issued to an eligible applicant at or after the expiration of a previous EAD issued under the same category.

Category being a family based adjustee category, which is documented as being eligible.

Just my two cents worth.

You're wise in thinking ahead, BUT don't worry too much about this and certainly don't mention it to the employer.

I advised my husband (when interviewing) to make as little noise about his immigrant status as possible. Just act like being an immigrant is 'no big deal'. In our neck of the woods, most employers weren't even savvy enough to ask questions. For those that were, my husband never gave the impression that immigration paperwork would cause a potential employer any extra bother.

It's hard enough to get a job without adding an extra obstacle.

Thank you Rebecca, this is such a valuable advice. I probably wouldn't mention anything regarding immigration, but the potential job is at the "City" and they look at absolutely every little thing and I was worried that the expiry date on my EAD may raise cocnerns. . I can't beleive how involved their hiring process is. I passed all pre-tests, and have interview today, so I wanted to be prepared just in case.

But you are absolutely right, half of the employers don't even know much about this stuff.

So true. We figured we'd tell prospective employers that it would not cost them anything to hire him and the only thing they needed to do was keep the I-9 on file. Anything to keep them from worrying about whether or not to hire him, yanno?

Thanks all for your replies. The reason I was concerned about EAD expiring in January is because the specific job I was applying for is a municipal government job. And they just informed me that I am the chosen candidate. The next step is fingerprints, reference check, drug test, medical, etc.....

It seems almost like immigration all over again, but I guess they want to be safe about who they are hiring.

And they completed everything else, I can't believe how detailed they are with references and everything else. Everything was fine, they gave me an offer and I accepted. So I will be working for the government!!! I am very happy that I got this job.

Don't worry, I work for the State of Georgia as , upon hire you complete the 1-9 and list your A# and expiry date of your work permit and they make a copy along with driver's licence and SSN for your records. They are just concerned that you have a valid one at the time of hire. I have been employed with the State for over a year and a half , my original card expired and they never requested a new one. I also changed from one county to another and they did not request any additional employment documentation.
