Do I need to prove extreme hardship for I-601 Application under INA Section 212(a)(3)(d)?

My husband's IR-1 Immigrate Visa was denied and the U.S. Counselor officer asked him to apply for I-601 under INA Section 212(a)(3)(d), for having been a member of Communist party.

Could anyone kindly advise if we need to prove extreme hardship in this case?

I very appreciate you kindly guidance.
