Hi :)

My fiance and I are the begining of our immigration journey. We have a first phone appointment with our attorney next tuesday.

My boyfriend (Canadian citizen) is a green card holder and Im also Canadian. We're not married yet and from what I understand il would be faster if he gets his USC first.Right know he's in Canada for a few months.

My first question is regarding his USC. I dont know if he'll be eligble because we traveled a lot in the past years,he lived more than 3 years in total the US but he came back for a year (360 days). He had his job in the US and was still getting paid.He had no lease during that year in the US and foward his Mail to his workplace.He's going back in January and Will find a new appartment.

What we planned to do is to get married here next month and file for a F2A.He'll go back to the US in January wait 3 months and file for his citizenship and hope he'll have if fast enough to help.I know that the processing time for an F2A is 2 Years. We have the opportunity to go in another country from septembre 2017 to June 2017 for his job (date are flexible and I can come Back to Canada at anytime) is it doable? I know we'll have a lot going on but it' s a way of being together for like 9 months.

He needs to be maintaining his US residency to keep his green card. Did he use Canadian healthcare or do anything else that may suggest he was a resident of Canada and not the USA? How long has he been outside the US currently? Did he get a reentry permit?

If he wants help with his naturalization please get him to join the board. Most of us here do not use a lawyer unless absolutely necessary.

F2A is about 2 years right now and CR1 is about a year. Depending on where he is it may take less time for him to naturalize. Once hes a usc he can do the K1 if you guys want to go that route.

He insists on getting a lawyer because of his many travels outside the US.

He's been in Montreal since June 17th. He Never needed A reentry permit. The year that should cause A problem was when he came in Montreal was back in 2013.

He asked for his medicare card back 2 weeks ago (they didnt deliver it yet) just in case something happen while he's here.

I dont think I want to go with the K1 route. It will drive me insane not to work for months. I dont have any family or friends in Chicago and he'll be busy.

He cannot use public Canadian healthcare. He should have travel insurance. Only canadian residents are allowed to use Canadian provincial healthcare. He can use US based healthcare but unless hes been in the USA for 5 years he shouldn't be using medicare either.

If he wants to pay a lawyer, thats his choice but get a good lawyer.
