Hi everyone,

my wife and I just got approved by the USCIS. The next step will be for my wife to fill out the I864 form,and we have one question. Since she filed her last taxes jointly with her now ex-husband, does she also have to hand in his W2? For some reason we can't make sense of the wording of the form, and the instructions only confused us more ;)

Any experience or advice you can share with us will be highly appreciated.

Hi,

You do not need the ex-husband's W2. You would only need it if he wanted to sponsor you.

Your wife can only use her income to sponsor you. You need to separate out what was her income and what was her ex-husband's income. You then report her income on the I-864.
