Situation: (M24)UK-->(F22)US

I have several chronic illnesses that prevent me from working full time. As such, I only meet the poverty line, but it's enough to provide for both my fiancé and I, especially as he's planning on getting a job as soon as he can.

Problem: My parents just refused to sign the co-sponsorship form. No one else I know will sign or meets the requirements to sign. They were basically our only chance.

Question: Does the co-sponsor form need to be filled out to get him into the country? Or is it just to get him his greencard?

Any answers and advice would be so greatly appreciated. I'm at the end of my rope and I don't have to tell him that our options are up when he wakes up.

You're going to encounter two different issues.

To get a K1, an I-134 needs to be provided. As you know, co-sponsors are usually one option, but London has also been known to accept the UK fiancé self-sponsoring if they have enough funds to do so. The I-134 is not a legally binding document. You have said your potential co-sponsors won't assist you, do you have any available assets that could be used in combination with your current salary?

Unfortunately though, you will encounter the next problem, of once the UK fiancé has the K1, and you marry, they must adjust status. It's important to do so in order to obtain a work permit and eventually the green card (he is not legally allowed to work without one of these).. but it also protects their status in the US. That more in-depth financial sponsorship document I-864 is legally binding. So... these are the two hurdles you seem to have, squeaking past one, will not necessarily help you squeak past the other.

I don't have enough info to know why your family refused to sign, but it's within their rights to do so. Even if you explained to them that the I-134 is not legally binding, and this was the issue for them, they would probably refuse to sign the I-864.

So in short yes, the I-134 needs to be filled out for the K1, or they are not getting in. Either by just you, it not using a co-sponsor and you have enough, or by just the co-sponsor (this is a London specific thing).

The I-864 is going to be the thing that will need to be filled out by you and whatever joint sponsor (if you had one) to allow him to remain after marriage and obtain an EAD and then green card.
