My husband didn't pay his taxes as he hardly gets any income and his boss is fooling the system saying he's self employed when in reality he's hired... I tried to make him file charge against his employer to irs but he has refused. Now till my question.

Will we get denied cr1 because of this? We have a co sponsor.

What should we do? We have no money to pay the $3800 taxes they want and that's without penalty.

Ouch. Fix the taxes first. Have your husband file as soon as possible listing income and where he got it from. You really don't want the IRS coming down on you. Unless your husband meets the support guidelines for 2 people 125% is $20,025 annual income then yes, you will need a co-sponsor. Ignore the boss situation that's not your problem. Your interviews are going to require proof of income/support so you really need to get it straightened out.

He's coming to my country and will have zero income as we are having a baby. And I'm not permitted back to usa as I overstayed my vwp because we found out I was pregnant day before flight and we had miscarriages before. I know not an excuse to overstay in the eyes of the law but that's the reason. So once he moves here he will have no income. Can get still apply for cr1 for me then? I also have a child so he would have to meet higher income demands. Think his taxes last year said he earned close to $21000. Don't know if we should try to file for cr1 BEFORE he comes here so he could send in his deposits for last three months with that application and then come here? Or he can't send that in at once? (Does he have to wait to send in tax/paystubs, if we manage to pay taxes?) It's all such a mess. Wish I would of attempted aos from inside of usa which was the plan but my bad health made me go back as health care is free here and now I've overstay but at least no time bar triggered.

We probably can get a co sponsor thst easily meet income demands

Your husband needs to clean up his tax situation and if he files for a spouse visa for you, you'll need a joint sponsor for the affidavit of support.

17 May 2016 - NVC Case Number Assigned

31 May 2016 - Sent AOS/IV package to NVC

5 Jul 2016 - NVC Case Complete

10 Aug 2016 - Medical Exam

25 Aug 2016 - Interview - APPROVED

1 Sep 2016 - Husband picked up his visa

Husband POE'd @ IAD - 5 November
