I am a single mom when I married my spouse which is an LPR. He filed a petition for me and we are now waiting for the interview. Based on the email that was sent to us we need to pay the IV for my daughter as well but I choose no to. My question is if I decide to get my daughter do I need to file another petition or I just need to pay her IV processing fee since she was also included in my petition. And how long do I have for me to be able to get my daughter ASAP. Thanks in advance

Your daughter is a derivative right? You should be able to bring her with you. I am just wondering why are you not paying the IV fee for your daughter?

The IV fee you are mentioning, is this the $325? Have you sent the AOS and IV package to NVC? Just trying to understand where in the process you are in.

That's right the 325 fee. I'm already waiting for the interview. Were not sure what document needed for her. My husband is afraid that it might affect my petition since he is not the biological father. If ever I pay the 325 fee on the interview is it possible? Thanks

Not sure what you mean that your petition might get affected. As I understand, she is a derivative because the child is yours, not necessarily child of the petitioner. I am not an expert and you can ask the others who might know about this.

But In my opinion, it should not affect your petition.

Like for example, if I petition my son or daughter who has a child (my grandchild), the child (my grandchild) is a derivative because the child (my grandchild) is the child of the beneficiary (my son or daughter), not because of the direct relation to the petitioner.

I don't recall any question in the form I-130 asking about the relationship between the petitioner (your husband) and the derivative child (your child) of the beneficiary (you).

Not sure if you can pay during the interview. I assume you have not completed your child's DS260 since you have not paid for her. The documents to send are the child's birth certificate, passport bio page photocopy, pictures (2x2 check the requirements on the picture)

And how did you say you are already waiting for interview? Have you submitted any documents to NVC? Did you already received an email from NVC that the documents you sent are complete and you are in queue for interview?

Btw, I am also assuming your husband is a permanent resident and not US citizen.
