I-94 taken by IO at AOS interview

Hi everyone,

Im just curious when a IO takes your i-94 at a greencard interview does it mean anything imparticular?

Im in limbo right now as im atill waiting for my infopass apt. I made a topic of my situation already.

Basically i applied for AOS on a F-1 , did fingerprints, interview went well the IO said everything was fine, no flaws no discripancys. And i should get a decision within 90days.

My PD was not current at the time of interview but it is now( i filed due to the new filing dates in october 2015)

Few days later i got a denial notice and it had no reason as to why i was denied i believe it to be in error and spoke with two lawyers who believe the same.

Made 2 service requests on NVCS and still havent heard anything.

But any input would be great, will i recieve back my i-94 since the application was denied?

I did try to get it online but it will only show info within the last 5yrs and i have not traveled since 2009

Do you have a copy of the original I-94 then?

If not, you could try filing G-884 (not sure how long it would take USCIS to get to you though)

You will not get the I-94 back.

File I-102 in order to get a replacement one. It does cost $330, so I'm not sure if going that way is the best thing for you.

Good to know there is a option to file for I-94 replacement!

Just need to pay extra $330. :P

I was hoping they could give it back to me at the info pass appointment or i could get some answers on the status of my case.

I cant believe they would mail a denial decision without stating a reason for why it was denied.

I doubt they will give it back to you at the infopass, doesn't hurt to try.

On what basis are you adjusting your status, family(marriage), employment? Or ?

According to where this is posted, you are adjusting through marriage, uscis should definitely justify the denial.

Get your lawyers working asap.

I am adjusting through family F2B and my priority date is aug 3 2009.

I applied oct 20 2015 because of the new filing application dates.

The denial letter states this as the reason;

"The evidence of record shows that, when you filed your application, you were present in the United States contrary to law because [ state reason, such as - your lawful nonimmigrant or parole status had already expired or you were present without admission or parole or you had engaged in unauthorized employment or etc.] you are not authorized to remain in the United States and should make arrangements to depart as soon as possible. ..."

That is the reason and i believe it to be a template and error.

This is so fustrating because everyday i get closer to losing my F1 status which is about to expire. And i have never worked without athourization, never entered the US illegally and never fallen out of status

They cancel your B2 (if that is the one you used to enter) which ultimately voids the I-94.

I am on a F-1 visa, the i-94 was in my passport valid for Duration of status. I am still in F-1 status but im wondering why he took it. Is that a good or bad thing?

it's not a bad thing, you shall get another I-94 the next time you will enter the US

Oh okay, but i just wondered why he would need it at the greencard interview if we submitted copies. Why would he need the original and copy

your I-94 becomes invalid once you file an immigrant petition from within the US. asking someone for a copy and than the original is common sense.
