Hi all,

I plan to visit my boyfriend soon in the US and work on filing the I 129 form together there. I noticed that if we did that we would have to answer yes and fill in question 15 "currently" in the US.. I only intend to stay for 3 weeks on a visitor visa and then come back to France for work... but does filling in it while I am there and therefore answering yes to the "fiance being in the us" create more problems? for example maybe the UScis thinking maybe that I would overstay? Is it better if my boyfriend files it after I am gone to answer "no " to that question?

I just wonder if it would raise any issues.

Yes, you need to answer and complete 15 to 15h do not leave them blank or answer "NO" ...Answer Yes and fill out the rest of the information being requested 15 to 15h...There should be no problem, this is why they have these questions...Just be sure your fiance does not Overstay.

I applied for the K1 while I was in the US. I answered yes for the question. It wasnt a problem at all and I got my visa and am in the US right now :). In fact, at the interview it worked in my favor that I had visited several times.

Our AOS Timeline (from K1)

Application posted - March 31 (overnight delivery)

Received - April 1

NOA received - April 10 (NOA date April 6)

Biometrics date - May 10

RFE received - May 23 (missing tax document for 2015)

RFE response sent - May 26

EAD Card produced - June 3

EAD received - ??
