My Fiance applied for the I-129F in Nebraska and got the NOA1 on 13th Feb 2007.

After this our problem started. I have searched and searched this site but cant find anyone with a situation similar to ours, so here goes.

On the 1st of March I was diagnosed with breast cancer. It is treatable and the prognosis is good but I have up to a years treatment ahead of me before I get the all clear. My oncologist says he has no problem with me emmigrating to the States once I'm all clear and will give me a letter and my medical history on a cd ROM to take with me, I appreciate that health insurance will be difficult but its not impossible and I have been reassured that in the worst case scenario if it recurs within a year or two then just jump on a plane back to the UK and they will treat me.

Well our dilemma is -

Do we inform the USCIS now about the unforseen delay or

Do we wait til I get packet 3 from the embassy in the UK after the approval, then send them an email requesting an extension to the 4 month deadline, explaining the situation.

This is obviously a very stressful time for me and my fiance and he is hoping to come over for a few months towards the end of my chemo to help me out.

I think we must be the only ones on here right now that ARE NOT in a hurry to get the I-129F approval. If there was any way to jump some of you ahead of us we would.

I hope you all get a speedy approval

You seem so levelheaded considering the recent diagnosis. Im glad to hear of your prognosis. I would carry on with the visa. You have 6 months to use it once you get it. After all the processing that needs to take place Im sure you'll be well on your way to recovery and still have your visa to use. At that time I'm sure the one thing you'll want to do is be with your man together in the States. Good luck and best wishes. Angie

JUst to add info for your time line. Going through CSC without any problems on the peition, will talke three months. Add another 2-3 months for the interview and visa. Then you can wait up to 6 months for the visa before you use it. You can slow down the process once London has the approved petition by not sending in your package 3 as quickly.

perhaps waiting until it eaches the consulate stage is your best option, you will know more of where you stand with your treatment by that point.

Best of wishes to you for your treatment and recovery.

Taking into account the speed in which the gov't works and the unnecessary delays that they add into the process, I would recommend going forward with your applications as normal -- perhaps delaying your replies to USCIS as mybackpages recommended.

The gov't will undoubtedly lag behind in processing the visa anyhow...

Later on when you actually get the visa, with it's 6 month validity, you can better judge your situation and status.

And what better way to celebrate the rest of your life than with a wedding. I think these are great ideas. The government IS very slow and you wouldnt want to be caught in some processing limbo when you'll be ready to move on. Good luck again.

I'm sorry to read of the challenges you are facing, and I hope all goes well with your treatment.

You will, of course, have to pass your medical exam by the panel physician prior to your visa interview. If your treatment begins soon, you should be well into it by then, and both you, your fiance, your doctor and the panel physician can help you decide.

There have been other members of VJ who were treating for illnesses during their process. Your situation is not impossible, and your timetable is realistic.
