Hi Everyone,

This site seems really helpful and I'm hoping someone can answer some specific questions for me regarding my situation:

- My fiance is from England but has been living and working in Australia for the past three years (where we met), does he need to return to England for any portion of the K1 process? He is not a resident or citizen of Australia but does have a valid visa to work there. Through some of the forum answers it seems that he can do the interview from Australia without an issue but since he isn't a resident I wanted to double check.

- I am pregnant and we are hoping (though know it is unlikely) that his visa will be approved and he will be in states in the fall when the baby is due. If that isn't the case, can he come on a visitor visa while waiting for approval? I've read a few topics with this question but it didn't seem very clear.

- I just returned to the states from Australia a few days ago and am eager to start this process immediately, however, I'm still securing employment. Since the initial packet of forms asks for my employment information and I understand that is a condition of my fiancee coming that I meet a minimum salary, should I wait until I have secured employment to submit the initial forms (129-F and G325A)?

Any insight is greatly appreciated!

He does not have to go back to England, you are the petitioner and he is the beneficiary and he can apply for Visa in Australia. Just be sure he get Police Certificate from England as well as Australia.

My fiance is from the Philippines but been working in Singapore for 4 years and that is where she will have her Visa.

As far as the employment, you don't have to send affidavit of support when you file. But, you have to send it to him before his interview for the visa. By that time maybe you have work, otherwise you have to have a sponsor.
