Hi everyone. I've been lurking here for a long time but now that my boyfriend and I are getting close to that time.. I'm trying to gather information. I've scoured this site like mad, as well as searched all over the internet and I can't find a direct answer for my question (all of what I find is about the foreign fiancée leaving their home country for a visit): Can my US citizen boyfriend leave the US while a K1 petition is up? Would that "cancel" our petition, or would it just be the same as if I were trying to get into the US ie bring proof of ties to the home country?

Thank you in advance, and I really am sorry if this is already posted somewhere and I'm just missing it...

Of course the US citizen can leave at anytime he wants, why wouldn't he? It's good if he visits the beneficiary while waiting for their I-129F to be approved.

But after the beneficiary enters the US on a K1 he/she can't leave until AOS has been filed and you have received travel authorization. Otherwise you will have to file for a spousal visa as the AOS would automatically be denied.

Thank you very much. I'm sure it sounds silly but I just want to be 100% sure before we start anything. I had this fear that our petition would be nulled if he left the USA and couldn't find any information on the petitioner leaving the US, just the foreign fiancée visiting the US. But anyway, thanks a lot. :)
