Hi everyone,

Just some background to start, I lived in Cambodia from 2012-2014 with my wife and my stepson. She is a Cambodian citizen and I'm a US citizen. Towards the end of 2014 I had to come back to the states for work. Before I came back, I decided to move my family to Thailand. The reason is because I wanted my stepson to go to school there and also my wife works at the Cambodia/Thai border as a customs officer so she would be closer to work and family. We have an apartment in Thailand. My wife comes to Cambodia for work and stays at her friend's house during the week and then goes back to our apartment in Thailand on the weekend. As a Cambodian, she can enter Thailand on a visa exempt stamp.

When I filed my I-130, I listed our Thai apartment as the present address because we didn't have our apartment in Cambodia anymore. When we received our case number it was a Bangkok case number. Which is fine because we'd rather process through Thailand. It's actually much closer to our apartment. The only problem is that the Thai Royal Police won't issue her a police certificate because she is considered a visitor and not a residence. They require her to have a residence visa or work permit.

I've been trying to get some help from NVC and they haven't been helpful at all. I've sent them inquiries and I'm still waiting for an answer after a month. I'm just wondering if anybody has had similar problems/experiences. I'm thinking that I might need to get them to change the case from Bangkok and have it go to Cambodia. My only concern is that the consulate in Cambodia will ask for a Thai police certificate anyway when they see that we have an apartment in Thailand.

Yeah, she has to be a legal resident in a country to be able to interview there. I believe it's a legal resident for six months, if I'm not mistaken.

Since your flat in Thailand is just a "holiday home", she wouldn't need a police cert from there, in theory. But since you put the Thailand address as the residence address, that might mess it up a bit. I assume you're renting, since neither of you are Thai citizens? Perhaps explain it that way, that the address in Thailand is just a holiday home you're renting and you mistakenly put that as your current address. And yes, I would assume you have to change the embassy to Cambodia, since that's her country of legal residence.

Thanks for the reply. Yes we are renting the house in Thailand. I used the Thai address because we no longer have our apartment in Cambodia. I guess I should have put down her friend's address that she was staying with while she's in Cambodia for work. Would I need to change the address on the g-325a and any other forms that has the Thai address listed in order to change embassy?
