Hi everyone, I got REF for I 864 on 1/25, we did submit I 864 tho when applying for AOS, however it was not from the petitioner, yeah it's our mistake, now USCIS ask for (a) I 864 from the petitioner and copies of the petitioner's most recent income tax return and all supporting tax documents (b) the joint sponsor on Form I 864's evidence of the joint sponsor's status (biographical page of unexpired US passport will do).. fair enough.. long story short, we came across some questions mainly regarding Part 7 when preparing for RFE.

My husband is still a student and his income doesn't exceeds the federal poverty guidelines, thus we have a joint sponsor. Our question is.. when my husband fills in I 864, in Part 7 Use of Assets to Supplement Income (Optional) it says: if your income, or the total income for you and your household, from Part 6, Item Number 19a-19c, exceeds the federal poverty guidelines for your household size, YOU ARE NOT REQUIRED to complete this Part 7. Skip to Part 8. So..does he need to fill in this part 7? I mean..even tho his income is not sufficient, but we will not use our assets to supplement income.. that's why we have a joint sponsor! Right?

If we still need to fill in Part 7, then in item 6 Assets of the principal sponsored immigrant (optional), do I need to provide my info such as the balance of the sponsored immigrant's savings and checking accounts? If so, will I need to provide supporting documents? I only have a certificate of account balance from my bank in my home country with me, and it's from 5/19/2015. Would that be ok?

The truth is I'm in panic now, again, and would really appreciate any advice. Thanks!!
